Terms of Sale
The owner of the Qilowatt.eu online store (hereinafter referred to as the Online Store) is QWATT OÜ (registration code 16373039), located at Veski, Kudina village, Jõgeva Parish, Jõgeva County, 49210, Estonia.
Validity of the Sales Agreement, Product and Price Information
These terms and conditions apply when purchasing goods from the Online Store. The prices of the products sold in the Online Store are indicated alongside each product. The price is subject to an additional fee for the delivery of the goods. The delivery fee depends on the buyer’s location and the chosen delivery method. The delivery fee is shown to the buyer during the order process. Information about the goods is provided in the Online Store, directly alongside the product.
Placing an Order
To order goods, the desired products must be added to the shopping cart. To complete the order, the required information fields must be filled in and a suitable delivery method for the products must be selected.
Next, the payment amount will be displayed on the screen, which can be paid via bank link or invoice in euros. The bank link service is provided by Montonio Finance UAB. The agreement becomes effective once the payment has been received in the Webshop’s account.
If the ordered goods cannot be delivered due to the item being out of stock or for any other reason, the buyer will be notified at the earliest opportunity, and the paid amount (including delivery costs) will be refunded without delay, but no later than 14 days from the date of the notification.
Delivery
Goods are shipped within Estonia via Itella and Omniva parcel terminals. The shipping costs are borne by the buyer, and the corresponding price information is displayed alongside the selected delivery method.
Domestic shipments within Estonia usually reach the buyer’s specified destination within 3–7 business days from the date the sales contract comes into effect. In exceptional cases, the seller has the right to deliver the goods within up to 45 calendar days.
Right of Withdrawal
After receiving the order, the buyer has the right to withdraw from the contract concluded in the online store within 14 days. The right of withdrawal does not apply if the buyer is a legal entity.
To return the goods, a declaration of withdrawal from the purchase must be submitted and sent by email to info@qilowatt.it no later than 14 days after receiving the goods.
The costs of returning the goods are borne by the buyer, except in cases where the reason for the return is that the item does not conform to the order (e.g., wrong or defective item). The buyer must return the goods within 14 days of submitting the withdrawal declaration or provide proof that the goods were handed over to the carrier within the aforementioned period.
The Webshop will refund all payments received from the buyer under the contract without delay, but no later than 14 days from the receipt of the withdrawal declaration. The Webshop may withhold the refund until it has received the returned goods or the buyer has provided proof of dispatch, whichever occurs first.
If the buyer has explicitly chosen a delivery method offered by the Webshop that differs from the cheapest standard delivery option, the Webshop is not obliged to refund the cost exceeding that of the standard delivery method.
The Webshop reserves the right to withdraw from the sales transaction and request the return of the goods from the buyer if the price of the goods in the Webshop was mistakenly listed significantly below the market price.
Right to Claim
The Webshop is responsible to the buyer for any non-conformity or defect of the goods sold that existed at the time of delivery and becomes apparent within two years from the date of delivery to the buyer. For the first six months from the delivery of the goods, it is presumed that the defect existed at the time of delivery. The Webshop bears the burden of disproving this presumption.
In the event of a defect, the buyer has the right to contact the Webshop no later than two months after noticing the defect by sending an email to info@qilowatt.it.
The Webshop is not responsible for defects that occur after the goods have been delivered to the buyer. If goods purchased from the Webshop have defects for which the Webshop is liable, the Webshop will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Webshop will refund the buyer all fees paid under the sales agreement. The Webshop will respond to a consumer complaint in writing or in a form that allows for written reproduction within 15 days.
Processing of Personal Data
The Webshop uses the personal data provided by the buyer (including name, phone number, address, e–mail address, and bank details) to process the order and deliver the goods to the buyer. The Webshop may share personal data with delivery service providers such as Itella Estonia OÜ, DPD Eesti AS, and AS Eesti Post for the purpose of delivering the goods, and with the authorized processor Montonio Finance UAB for the purpose of processing payments.
QWATT OÜ may send clients information about its services, products, newsletters, and offers via e–mail or phone if the client has voluntarily provided their contact details and given consent. This will continue until the client requests the cessation of such communications or unsubscribes from the newsletter, notifying the Webshop by e–mail at info@qilowatt.it or following the instructions provided in the offer. Dispute Resolution
If the buyer has any claims regarding the Webshop, they must be sent by e–mail to info@qilowatt.it. If the buyer and the Webshop cannot resolve the dispute amicably, the buyer may turn to the Consumer Disputes Committee under the Consumer Protection and Technical Regulatory Authority. The Committee has the competence to resolve disputes arising from the contract concluded between the buyer and the Webshop. Reviewing the buyer’s complaint at the Committee is free of charge. For cross-border disputes, the buyer may use the European Union’s Online Dispute Resolution platform.
